1. Parties
These Terms govern the relationship between Mughal Sons Construction ("the Contractor"), registered and operating in Islamabad and Rawalpindi, Pakistan, and any individual, company, or entity ("the Client") that engages our services.
2. Scope of Services
Mughal Sons Construction provides the following services:
- Custom home building and grey structure construction
- Building construction and civil engineering works
- Home renovations and remodeling
- Construction site excavation and earthwork
- Concrete works — slabs, columns, beams, foundations
- Interior design and finishing
- Flooring installation (tile, marble, granite, wood)
- Kitchen and bathroom remodeling
- Repairs and general building maintenance
- Civil engineering consulting
The exact scope for each project is defined in the signed project agreement or work order between the Client and the Contractor.
3. Quotations and Pricing
All quotations provided by Mughal Sons Construction are:
- Valid for 30 days from the date of issue unless otherwise stated.
- Based on the information provided by the Client at the time of enquiry.
- Subject to revision if the scope of work changes after agreement.
Material prices are subject to market fluctuation. Where material costs increase by more than 10% after agreement, the Contractor will notify the Client and agree on any adjustment before proceeding.
4. Payment Terms
Standard payment schedule for construction projects:
- 30% advance payment on signing of project agreement.
- 40% upon completion of grey structure / halfway milestone (as defined in the agreement).
- 20% upon commencement of finishing works.
- 10% final payment on project handover and client sign-off.
Payment schedules for smaller renovation or repair jobs may differ and will be agreed in writing before work commences. Delayed payments may result in work pauses; the Contractor will provide 48-hour written notice before any suspension of works.
5. Client Responsibilities
- Provide accurate site access, measurements, and required permits before work begins.
- Ensure the site is free from existing structural hazards not disclosed at quotation stage.
- Make payments as per the agreed schedule to avoid project delays.
- Communicate design changes in writing — verbal instructions will not be acted upon without written confirmation.
- Obtain all necessary local authority approvals and building permits before construction begins. The Contractor can assist with this process but is not responsible for obtaining permits on the Client's behalf unless explicitly agreed.
6. Contractor Responsibilities
- Provide skilled, experienced workers and supervisors for all project work.
- Use materials of the quality and specification agreed in the project agreement.
- Maintain a clean and safe worksite throughout the project.
- Notify the Client promptly of any delays caused by weather, material unavailability, or unforeseen site conditions.
- Complete the project within the agreed timeline, subject to valid extensions for force majeure events.
7. Warranty
Mughal Sons Construction provides the following warranty on completed work:
- Structural works (foundation, columns, slabs, beams): 5-year warranty against structural defects attributable to workmanship.
- Finishing works (plastering, tiles, painting): 1-year warranty against defects attributable to workmanship.
- Plumbing and electrical: 1-year warranty on installed components (manufacturer warranties apply to fixtures and fittings).
Warranties are void if the Client or a third party modifies the work without the Contractor's written consent, or if damage results from misuse, natural disasters, or events beyond the Contractor's control.
8. Changes and Variations
Any change to the agreed scope of work must be requested in writing by the Client. The Contractor will provide a written variation estimate before proceeding. Verbal instructions will not be acted upon. Variations may affect the project timeline and cost.
9. Limitation of Liability
The Contractor's maximum liability for any claim arising from a project shall not exceed the total contract value paid by the Client for that project. The Contractor is not liable for indirect, consequential, or loss-of-use damages arising from construction delays or defects unless caused by gross negligence.
10. Dispute Resolution
In the event of a dispute, both parties agree to first attempt resolution through good-faith negotiation. If unresolved within 30 days, the dispute shall be referred to mediation or the courts of Islamabad, Pakistan, under the laws of Pakistan.
11. Governing Law
These Terms are governed by the laws of the Islamic Republic of Pakistan. Any legal proceedings shall be conducted in the courts of Islamabad.
